Terms of Service

Please read these Terms of Service ("Agreement" or "Terms") carefully before using the services offered by Ling0 ("Ling0," "we," "us," or "our"). This Agreement sets forth the legally binding terms and conditions for your use of the Ling0 website and all related services, including any features, content, or functionalities offered from time to time by Ling0 (collectively, the "Service(s)").

Ling0 is operated by Diego Valades, an individual residing in Spain.

By using the Services in any manner, you agree to be bound by this Agreement. If you do not agree with any part of these Terms, you must not use the Services.

1. Acceptance of Terms

The Service is offered subject to acceptance without modification of all of these Terms and all other operating rules, policies, and procedures that may be published from time to time in connection with the Services by Ling0. Ling0 may, in its sole discretion, refuse to offer the Service to any person or entity and change its eligibility criteria at any time.

2. The Service

Ling0 is a language-learning platform that helps you prepare for real conversations by rehearsing them out loud with AI conversation partners, alongside a personalised learning path of grammar, vocabulary, writing, and listening practice. The Service is provided for personal, educational purposes.

Much of the Service is generated by artificial intelligence, including conversation partners, voices, corrections, translations, grades, and feedback. AI-generated content can be inaccurate, incomplete, or inappropriate for your situation. The Service is not a certified language qualification, a substitute for a qualified teacher, or professional translation or interpretation. Grades and progress scores are for your own practice and are not intended for admission, certification, or any official assessment.

3. Account Registration and Responsibilities

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Promptly update any information that becomes inaccurate
• Accept responsibility for all activities that occur under your account
• Not share your account credentials with others

Each person must have a unique account. You may not create more than one account. You must be at least 16 years of age to create an account.

4. Rules and Conduct

As a condition of use, you promise not to use the Service for any purpose that is prohibited by these Terms. By way of example, and not as a limitation, you shall not:

• Use the Service in any way that violates applicable local, national, or international law or regulation
• Impersonate or attempt to impersonate another person or entity
• Engage in any conduct that is defamatory, harassing, abusive, threatening, or otherwise objectionable, including in conversations, writing, and scenarios you create
• Use the AI features to generate unlawful or harmful content, or attempt to manipulate them into behaving outside their intended purpose
• Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems or networks connected to the Service
• Use any method to extract data from the Services, including web scraping, web harvesting, or web data extraction methods
• Interfere with or disrupt the proper working of the Service, including imposing an unreasonable load on the Service's infrastructure
• Bypass any measures Ling0 may use to prevent or restrict access to the Service
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission
• Reverse assemble, reverse compile, decompile, or otherwise attempt to discover the source code or underlying systems of the Service, except to the extent applicable law expressly permits it

5. Your Content

You keep ownership of what you say, write, and create in the Service, including your spoken conversations, writing, answers, and custom scenarios ("Your Content"). You grant Ling0 a non-exclusive, worldwide, royalty-free license to host, store, process, and transmit Your Content, including to the service providers described in our Privacy Policy, solely to operate, provide, and improve the Service for you. This license ends when Your Content is deleted from the Service, subject to the retention described in our Privacy Policy.

You are responsible for Your Content and confirm that you have the rights needed to submit it.

6. Intellectual Property Rights

Unless otherwise expressly indicated, all content displayed or made available on the Service, excluding Your Content, including without limitation text, graphics, logos, design elements, lessons, exercises, scenarios, images, audio, software, and the selection, compilation, and arrangement of any of the foregoing, is owned by Diego Valades and is protected by copyright, trademark, and other intellectual property laws.

Subject to these Terms, Ling0 grants you a limited, non-exclusive, revocable, and personal license to access and use the Service for personal, non-commercial purposes. All rights not expressly granted to you are reserved.

All registered and unregistered trademarks, logos, and service marks are the property of Diego Valades or their respective owners. Nothing displayed on the Service shall be construed as granting any license or right to use any trademark without the owner's prior written permission.

7. Privacy

Our commitment to privacy and data protection is reflected in our Privacy Policy, which describes how we collect and process information that identifies you. Please review it to understand our practices.

8. Copyright and Takedown Policy

We respect intellectual property rights and ask our users to do the same. If you believe that any content on the Service infringes your copyright or other rights, email us at hola@ling0.app with a description of the work, where it appears on the Service, and your contact details. We will review notices promptly and remove or disable access to infringing content where appropriate. We reserve the right to terminate access for repeat infringers.

9. Termination

You may delete your account at any time from the Account tab of the Settings page. Upon deletion, your account and the learning data tied to it in the Ling0 application database will be removed and active sessions will be ended, subject to reasonable retention of backups, logs, email-delivery records, records held by our service providers, and information we must retain for legal, security, or operational reasons.

Ling0 may terminate or suspend your access to the Service at any time, without prior notice, if you fail to comply with these Terms. Upon any termination, all rights and licenses granted to you in this Agreement shall immediately cease.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. Except to the extent prohibited by law, we make no warranties, express or implied, with respect to the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no warranty that the Service will meet your requirements, will be uninterrupted, timely, secure, or error-free, or that any results obtained from the use of the Service will be accurate or reliable.

Corrections, grades, translations, progress scores, and other feedback provided by the Service are informational only and should not be relied upon where accuracy matters, such as legal, medical, or official communication.

11. Limitation of Liability

To the maximum extent permitted by law, Diego Valades shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, whether based on contract, tort, negligence, or otherwise, resulting from your use of or inability to use the Service. In no event will total liability exceed one hundred euros (€100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intentional misconduct or gross negligence, or your statutory rights as a consumer.

12. Indemnification

To the extent permitted by applicable law, you shall defend, indemnify, and hold harmless Diego Valades from all liabilities, losses, claims, and expenses, including reasonable legal fees, that arise from or relate to your misuse of the Service or your violation of these Terms.

13. Third-Party Content

The Service may embed or link to third-party content, such as YouTube videos, or other websites and resources. These are provided solely as a convenience, and Ling0 is not responsible for the content, privacy policies, or practices of any third party. Your use of third-party content and sites is at your own risk and subject to their respective terms and policies.

14. Modification of Terms

We may modify these Terms at any time by posting a revised version on this page with an updated "Last updated" date. For material changes, we will give you reasonable notice, for example by email or in the Service, before they take effect. Your continued use of the Service after any change takes effect constitutes acceptance of the revised Terms. If you do not agree, you may stop using the Service and delete your account.

15. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of Spain. Disputes shall be brought before the courts of Barcelona, Spain, except where applicable consumer-protection law gives you the right to bring claims before the courts of your place of residence or entitles you to the protection of the mandatory laws of your country of residence.

16. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. The failure of either party to exercise any right provided herein shall not be deemed a waiver of any further rights.

17. Entire Agreement

These Terms, together with the Privacy Policy, contain the entire agreement between you and Diego Valades regarding your use of the Service and supersede any prior or contemporaneous agreements or communications on that subject.
